1. Acceptance of Terms

By accessing and using motohive ("the Website"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.


2. Service Description

motohive is an online marketplace that connects car sellers with potential buyers. Our platform allows users to:

  • • Browse car listings with detailed information and images
  • • Post car advertisements for sale
  • • Use AI-powered search to find specific vehicles
  • • Contact sellers directly through our platform

3. User Accounts and Registration

To access certain features of the Website, you may be required to create an account. You are responsible for:

  • • Maintaining the confidentiality of your account credentials
  • • All activities that occur under your account
  • • Providing accurate and complete information during registration
  • • Notifying us immediately of any unauthorized use of your account

4. Listing Policies
4.1 Listing Requirements

All vehicle listings must:

  • • Show the actual vehicle being sold — stock photos or images of a different vehicle are not permitted
  • • State the correct registration number, VIN, make, model, year, and recorded mileage
  • • Disclose the current NCT status and expiry date
  • • Disclose whether the vehicle has any outstanding motor finance (HP, PCP, lease)
  • • Disclose any known mechanical faults, accident damage, or structural repairs
  • • Accurately describe the vehicle's service history (full, partial, or none)
  • • State whether the vehicle has ever been written off (categories A, B, S, N or equivalent Irish insurance write-off)
  • • Correctly identify the seller as a private individual or a motor trader (see section 4.3)
4.2 Prohibited Listings

The following are strictly prohibited on Motohive:

  • • Stolen vehicles or vehicles with altered, cloned, or removed VIN/chassis numbers

    Listing or selling a stolen vehicle is a criminal offence under the Criminal Justice (Theft and Fraud Offences) Act 2001.

  • • Clocked vehicles (odometer fraud)

    Tampering with or misrepresenting a vehicle's mileage is a criminal offence under section 5 of the Road Traffic Act 2014 and the Consumer Protection Act 2007. Any vehicle sold must display its true recorded mileage.

  • • Vehicles with undisclosed outstanding finance

    Selling a vehicle subject to undisclosed HP or PCP finance may constitute fraud. Sellers must settle or disclose any outstanding finance and, where applicable, obtain written consent from the finance company before listing.

  • • Insurance write-offs without full disclosure

    Any vehicle that has been declared a total loss (write-off) by an insurer must be declared as such, including the category (structural / non-structural). Concealing write-off status is a misleading commercial practice under the Consumer Protection Act 2007.

  • • Vehicles with materially false descriptions

    Including false service history documentation, manipulated Cartell/HPI reports, false NCT certificates, or invented ownership claims.

  • • Duplicate or speculative listings

    Listing the same vehicle more than once, or listing vehicles not owned by or under the seller's direct control, is prohibited.

  • • Vehicles not roadworthy and not disclosed as such

    If a vehicle is being sold as non-roadworthy, for parts, or for restoration, this must be prominently stated.

  • • Vehicles with an active Garda seizure order or court order restricting sale
4.3 Seller Classification — Private Sellers vs. Motor Traders (Anti-Curbstoning)

Motohive requires all sellers to accurately identify themselves as either a private individual or a motor trader. Misrepresenting your status is a violation of these Terms and may constitute a criminal offence under the Consumer Protection Act 2007 and the Consumer Rights Act 2022.

You are a motor trader if you regularly buy and sell vehicles for profit, regardless of whether you hold formal premises or a dealer licence. Selling two or more vehicles within any rolling 12-month period for commercial gain is generally considered trading under Irish and EU law. The Competition and Consumer Protection Commission (CCPC) and An Garda Síochána may investigate individuals suspected of unlicensed dealing.

"Curbstoning" — the practice of an unlicensed or unlicensed-appearing dealer listing vehicles as a private seller — is prohibited on Motohive. We reserve the right to:

  • • Remove any listing we reasonably suspect to be from an undisclosed trader
  • • Suspend or permanently ban accounts showing patterns consistent with commercial dealing (multiple listings, rapid turnover, repeated same-type vehicles)
  • • Report suspected unlicensed trading to the CCPC or An Garda Síochána

Motor traders must register on Motohive as a dealer account. Dealer listings are clearly marked, giving consumers the information they need to understand their legal rights before purchasing.

4.4 Outstanding Finance & Legal Encumbrances

Buyers are strongly advised to obtain an independent vehicle history check (e.g. MotorCheck) before purchase. A history check may reveal outstanding HP/PCP finance, previous write-off status, NCT history, and previous registrations.

Sellers who list a vehicle with outstanding finance must either discharge the finance in full before transfer of ownership, or arrange for the buyer and finance company to agree a simultaneous settlement at point of sale. Failure to do so may expose the seller to civil and criminal liability.


4A. Marketplace Obligations — Consumer Rights Act 2022

The Consumer Rights Act 2022 (which gives effect to EU Directive 2019/2161, the "Omnibus Directive") imposes specific transparency obligations on online marketplace operators such as Motohive. The following disclosures are required by law:

Seller Identity Disclosure

Before a consumer concludes a purchase through a listing on Motohive, we disclose whether the seller is a trader or a private individual. Where the seller is a private individual, we inform the consumer that statutory consumer protection rights (including rights to repair, replacement, or refund under the Consumer Rights Act 2022) do not apply to that transaction. Private sales are conducted on a caveat emptor (buyer beware) basis unless the parties agree otherwise in writing.

Search Ranking Transparency

Under Article 7 of the Omnibus Directive (implemented in Irish law), marketplace operators must explain the main parameters used to rank search results. On Motohive:

  • • Default sort order is 'Most Recent' — listings are ordered by the date they were submitted to the platform, newest first.
  • • Users may re-sort by price, year, mileage, or make using the sort controls provided.
  • • Motohive does not currently accept payment to boost or promote individual listings above organic results. If paid promotion is introduced, promoted listings will be clearly labelled as 'Sponsored'.
Motohive's Role in Transactions

Motohive is an intermediary marketplace. We facilitate the connection between buyers and sellers but are not a party to any transaction. We do not take title to any vehicle, set prices, hold funds, or provide any warranty on vehicles listed. The contract of sale is formed directly between the buyer and the seller.

Where a listing is from a motor trader and the buyer is a consumer, the trader is solely responsible for compliance with all obligations under the Consumer Rights Act 2022, including the right to conformity with contract, the right to repair or replacement, and any applicable guarantee.


5. Advertising Fees and Payment Terms
5.1 Fee Structure

Our current advertising fees are as follows:

  • • Basic Listing: €29.99 per month

    Includes up to 10 photos and basic search visibility

  • • Premium Listing: €49.99 per month

    Includes up to 20 photos, featured placement, and priority in search results

  • • Featured Listing: €79.99 per month

    Includes unlimited photos, top placement, and enhanced visibility features

5.2 Payment Terms

• All fees are charged in advance on a monthly basis

• Payments are processed securely through our payment partners

• Payments are non-refundable once processed, including where you choose to delete your ad before the listing period expires

• We reserve the right to modify our fee structure with 30 days' notice


5.3 Ad Deletion

You may delete your ad at any time from your My Ads page. Deletion is permanent and cannot be undone. Advertising fees already paid are non-refundable upon deletion, regardless of how much of the listing period remains. If your ad was pending review at the time of deletion, no refund will be issued.


6. Data Usage and Privacy
6.1 Information We Collect

We collect the following types of information:

  • • Account information (name, email, phone number)
  • • Vehicle information and images you upload
  • • Search queries and browsing behavior
  • • Communication data between buyers and sellers
  • • Technical data (IP address, browser type, device information)
6.2 How We Use Your Data

We use your information to:

  • • Provide and improve our car listing services
  • • Process payments and manage your account
  • • Enable communication between buyers and sellers
  • • Provide customer support and resolve issues
  • • Analyze usage patterns to improve our platform
  • • Comply with legal obligations and prevent fraud
6.3 Data Sharing

We may share your information with:

  • • Other users (as necessary for the service)
  • • Service providers who assist in our operations
  • • Law enforcement when required by law
  • • Business partners with your consent

7. User Responsibilities

As a user of motohive, you agree to:

  • • Provide accurate and truthful information in all listings
  • • Respect the intellectual property rights of others
  • • Not engage in any fraudulent or deceptive practices
  • • Comply with all applicable laws and regulations
  • • Not interfere with the proper functioning of the Website
  • • Report any suspicious or inappropriate content

8. Disclaimers and Limitation of Liability

Motohive operates as an intermediary platform and does not own, inspect, appraise, or guarantee any vehicle listed. We make no representation as to the accuracy, completeness, or fitness for purpose of any listing content, and we are not a party to any transaction between buyers and sellers.

Independent verification: Buyers are strongly advised to independently verify all material facts about a vehicle — including via a professional inspection, a history check (MotorCheck or equivalent), and confirmation of the seller's identity — before agreeing to purchase. Motohive does not perform VIN checks, finance checks, or NCT verifications on listed vehicles.

Safe payment: Motohive strongly advises against paying a deposit or full price before viewing a vehicle in person. Advance-fee fraud ("I'll ship the car — pay now") is common in online car sales. We do not facilitate payment processing and will never instruct you to pay via bank transfer, cryptocurrency, gift cards, or money transfer services in connection with a listing.

Limitation: To the fullest extent permitted by Irish law, Motohive's liability arising from or related to use of this platform is limited to the fees paid by you to Motohive in the 12 months preceding the claim. Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

AI search: Our AI-powered search feature is provided as a convenience tool and may not return exhaustive or perfectly accurate results. It should not be relied upon as financial, mechanical, or legal advice.


9. Termination

We may terminate or suspend your account and access to our services at any time, with or without cause, with or without notice. Upon termination, your right to use the service will cease immediately.

These Terms of Use constitute the entire agreement between you and motohive regarding the use of our service. If any provision of these terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
